Justification: "The Baltimore County Council should review this property to determine whether potential development is consistent with neighborhood concerns, the Master Plan and applicable community plans, and infrastructure and schools."

Planning staff recommendation: "Staff recommends no change in zoning since there was no justification for the change and the Master Plan has not been updated since the last CZMP."

Comments: The Kingsville Community Plan (1996) identified water supply (wells) and underground fuel tanks as major concerns. It recommends that "the CR district overlay or the RCC zone be maintained on commerical properties and be placed on properties which may obtain commerical zoning in the future" That statement is followed in the Plan with a picture of the subject property. BM zoning (Business Major) is, by its definition and allowable uses, incompatible with a small village like Kingsville. All commercial areas should be BL (local) or RCC.
It should be noted that any "downzoning" would have no impact on existing legal uses, but would prevent other undesirable uses if the current use ended. Uses allowed by BM that a change would prevent include: a catering hall, a nightclub, and, by Special Exception, a drive-in restaurant, car wash, pawnshop, and striptease establishment. Last CZMP the areas on the other side of Belair Rd and Bradshaw Rd were changed to RCC.
