Bill 58-21, PUDs

Benefits:

This Bill further weakens the requirements for a PUD. This has been going on for years via multiple Bills.

Citizens want a well controlled and limited PUD process, which is apparently what the original system was. For, example, it should require:

  • Minimum area under common ownership or control - at least 20 acres.
  • Consisting of multiple different zonings.
  • End result may never exceed uses or density not allowed by the underlying zoning - no exceptions.
  • Being a PUD does not allow avoidance of any other restriction or requirement in the Code or Master Plan.

The whole purpose of a PUD is to allow rearrangement of uses and density already allowed by the existing zoning.
