Bill 66-17, Residential Uses in ML Zones Adjacent to CT Districts

This Bill allows residential use in ML if:

  • at least 10 acre
  • within 525 feet of the BM-CT District of White Marsh (White Marsh Mall)
  • part of a contiguous area of 200 acre or more of ML west of I-95
and exempts development from §102.2

This is completely bizarre. There is no imaginable reason why a residential use in ML should be dependent on being near a business zone. This is obviously finely crafted wording to apply to a specific property. It is clearly the currently vacant properties at 8120 and 8130 Corporate Dr which is:

  • 13 acres
  • 460 ft from the BM CT District (and 512 ft from the actual property of White Marsh Mall in that District)
  • part of 256 acres of ML west of I-95

During the legislative seesion on Nov 20, extensive amendments were made, the most significant of which was by Jones, in a "me-too" move, to add a similar allowance for a BM zone near the Owings Mills CT zone. Only one property can be found that this would apply to - Foundry Row, owned by GGCV (Greenberg Gibbons) Real Estate, which seemed to be already filled with commercial development. And this amendment provides that the open space waiver fee applied to the new residential uses would be the same as in a CT District - obviously being much lower.

In another case of seriously hiding the facts, the 2 properties originally affected were bought by White Marsh Acquisition, LLC in Aug 2017, which had just been formed in June 2017 in Delaware, headquartered at 23622 Calabass Rd, #200, Calabass, CA, which appears to be just a mail drop at a property management company called Ezralow. But its address in the SDAT records is Suite 700, 7200 Wisconsin Ave, Bethesda, which is Stonebridge Carras, a real estate development and investment firm. White Marsh Acquisition's resident agent is National Registered Agents, Inc of Maryland, which is supposedly located at the 2nd Flr, 836 Park Ave, Baltimore, which appears to be just a town house/condo, but also the office of Corp Assist, LLC, whose resident agent is John Christel, but is now forfeited. But the news article said it is owned by Chesapeake Realty Partners, which is at 4750 Owings Mills Blv and traces back to Barry Greenberg. So what really is the truth?
