Bill 75-21, Kennel in BM IM

This Bill allows a Commercial Kennel if:

  • located in IM District
  • located in Hunt Valley/Timonium Master plan area
and with the following restrictions:
  • outdoor space not used 9pm-6am
  • no closer than 500 ft from residential use except can be 100 ft if "across from a Major Collector Road"
Obviously, the word "from" is not intended in the above. It's simple things like that which could negate the Code in court.

Since this Bill establishes setbacks, it is admitted that this use could have potential negative impacts on nearby residences. At the work session, Kach intimated that the intended property was "across from Sherwood" on York Rd. (York Rd is a Principal Arterial road, so the reduced 100 ft setback would not apply here.) It has been confirmed that the intended business is for dog training, not boarding as "kennel" would imply, in the rear of the Ace hardware at 10912 York Rd.

Further, within the urban area, there is no longer a distinction between "major" and "minor" collector roads.

Is is unknown how one measures a set-back from a "residential use". It would be easy to argue that means from any part of the parcel used as a residence in residential zoning. The front door of this intended use is 430 ft distant from residential (across an Arterial road) and thus not allowed. It's unknown what outside area they intend to use, if any.

It is unknown why this use would come under the "kennel" use.
